Harvard Educated Specialist wins the “genius” visa, eventually!

Brilliant Education Technologist with a Masters degree from Harvard applied for the EB-1A (Alien of Extraordinary Ability) visa and got a Notice of Intent to Deny (NOID). That was when he reached out to us.

A NOID must be responded to within 30 calendar days.

He had argued for 7 criteria and got approved for 5 out of the 7.

Given that he met at least three out of the ten types of evidence listed in the regulations, a final merits analysis was conducted on his case. This was where he fell short.

He was deemed to have provided INSUFFICIENT documentation to satisfy two of the toughest criteria: receipt of national or international awards for excellence in the field (Criterion 1) and original contributions of major significance in the field (Criterion 5).
